Appeals and Postconviction Remedies

Criminal Appeals

You have been convicted by a jury. What do you do now? Vanguard Defense Group will closely review and analyze the trial record to challenge the legal and factual errors made during the trial, with the aim of reversing the conviction or getting a new trial.

Petition for Post-Conviction Relief

You have taken a Plea Deal and been sentenced to probation or prison...Now what? Vanguard Defense Group will analyze the Plea, the conviction, and the related laws to make sure the plea agreement and sentence were fair and lawful. If mistakes were made in the plea-process, or you sentence is unlawful, we will advocate for reversing the conviction or getting you resentenced.

Habeas Corpus

Habeas Corpus is a fundamental legal principle that safeguards an individual's right to challenge their detention or imprisonment. Vanguard Defense Group will comb through the records of your case to test the legality and constitutionality of your detention by filing a Petition for Habeas Corpus. The roots of habeas corpus lie in the notion that the power of the state should be limited and that individuals should be protected from arbitrary exercises of authority. We will present evidence and arguments to challenge the lawfulness of your confinement. In turn, the habeas court should carefully examine the merits of the case, considering factors such as the validity of the arrest, the conditions of detention, and any violations of constitutional rights.

Termination of Probation/Revocation

For Probation issues such as Revocation Proceedings, or if it's time to petition the Court to end your Term of Probation, Vanguard will expertly advocate for your freedom and to protect your rights.

Conditions of Confinement or Arrest: Lawsuits under 42 USC §1983

Vanguard Defense Group will zealously pursue your lawsuit against state or local government officials, employees, and entities for violations of your constitutional rights. Section 1983 is most often used in cases involving police misconduct, unlawful arrests, and other abuses of power by government officials. If your rights have been violated under color of state law, we will seek damages or other remedies for the violation.
